I have had this confirmed at the County, State, and Federal level. In each instance I was told that what I found was correct, and in each instance I was given the same "defense" of this lunacy (law)

I doubt Mohammad Atta would have been concerned about the ramifications of checking a box on a form, I doubt Al Qaeda would be concerned, and I highly doubt the 20 million illegals who have snuck into this country and use someone else's SS number for employment (which is felony identity theft and felony document fraud) would hesitate to check a box on a form.

In 2002 Congress passed the Help America Vote Act. 49 of 50 states have now conformed to HAVA. Arizona is being sued to force them to conform to HAVA. Arizona is the only state that requires proof of citizenship to register to vote.

“When Congress passed HAVA, it specifically required states to get the driver’s license number or the last four digits of the applicant’s social security number and to verify that number. However, Congress specifically provided for applicants who did not have one of those numbers to be registered. ”
“Congress has also prohibited states from requiring proof of a person’s eligibility (for example, birth certificate or naturalization papers) in order to register to vote.”

HERE IS HOW IT'S DONE
By Law – Anyone who is undocumented MUST be accepted as a Registered United States Voter as long as they check the box on the voter registration form claiming to be a U.S. Citizen.
Each state wrote their own laws to conform to HAVA so the legal terminology and voter registration forms differ but the end result is the same in 49 of 50 states.
1) By Law - It is required that Citizenship of a new voter be verified through the applicant marking the box claiming to be a U.S. Citizen when registering to vote, but it is ILLEGAL to request a birth certificate, or Naturalization papers.
2) By Law - It is ILLEGAL to verify Citizenship of a new voter at the time of voting. (at polling place)
3) By Law - When registering to vote, if anyone checks the box claiming to be a U.S. citizen but has no ID, THEY MUST be accept as a registered US voter.
I found this in Florida’s laws first and here it is called the "none" provision, other states call it other things, but the result is the same.
Once you use the "none" provision you automatically receive a voter registration card and your state issues you an official voter number to identify you.
Once you have your voter registration card with voter number in hand you must vote in person in most states. At that time you must bring your identification with you to vote, BUT since you registered under the "NONE" provision you are allowed to use a non-government and non-official ID
Under federal law each state can decide which non-official ID to accept at the time of voting if you registered under the "none" provision, but BY LAW it can ONLY be used to verify a match of the name on your voter registration card at time of voting, it CAN NOT be used to verify citizenship.
For example: FL accepts a Sam's club card (among other things) but not a utility bill, However IL accepts a utility bill (among other things) but not a Sam's club card.
The federal law requires each state to accept ONE of several non-official ID's, but each state can pick which and how many to choose from.
The trouble is these non-official non-government ID's can be made by any 6th grader on their home computer.

WHY ONLY 49 AND NOT 50 STATES?
Per the Federal Elections Paralegal I spoke with Arizona is the one state that doesn't conform to Federal Law as they require real and solid proof of citizenship, BUT this official said there are challenges to this in court.
When I asked this official straight out what the chances were of AZ being forced to conform the short reply was "soon it will be all 50 states".
What unofficial ID does your state accept to cast a vote, a Sam's club card, a utility bill, a workers badge from any company, a comic book subscription ?
Some states tell you straight out, but some hide it. Some require nothing at all. You will find it written into your states legislation. I have supplied links to a few below.

The Federal Elections Paralegal I spoke with (who had over 20 years experience) confirmed undocumented foreign nationals ARE registering, but not with intent to vote (yet) What they are doing with their registered US voter number is putting it onto an I-9 form and due to a loophole in the I-9 legislation that form then becomes accepted government proof of citizenship.
